Plan Commission Members Present: Chairman John Kendall, Vice-Chairman Bob David, Jeff Auberger, Jamie Hart, Nancy Manschot, Mariette Nowak, and Craig Messerschmidt.
Members of the Audience: 3 members of the public.
Commission Actions, Decisions and Discussions
Unapproved Minutes of the February Monthly Meeting held on February 1, 2012.
Motion: Auberger/Nowak, to approve. Motion Carries 5 ayes/0 opposed/2 abstain.
Board of Adjustment Response: Kossow/Centurylink Variance Decision
Response was received from Deb Grube of Walworth County Board of Adjustment (BOA). Bob David read response that stated the BOA definitely wants the Towns recommendations but in this case they felt the variance request was for a public good and felt the existing location of the utility cabinet left few alternatives. She stated the decision no way reflects on the Town nor does it mean the Board does not want to wait for the Towns recommendations.
Bob David’s concern is not for this situation but that of being informed. Auberger asked are we involved, or are we not? He thought a copy of County’s application should be forwarded to the Town, and suggest maybe the BOA not hear the request unless the Town is notified. Secretary and Chairman stated in previous communication with BOA, applicant is directed to come to the Town and submit to the Clerk, and we can check upcoming hearings scheduled on the Walworth County website. David stated if we check the website, how would we go about contacting the applicant if nothing has been submitted to the Town in the timeframe to have any input?
Motion: Kendall/Auberger, to have Michele send a letter to the County Board of Adjustment to give us a response on the timely information needed for them and us to make a decision.
Motion Carries 7 ayes/0 opposed.
Re-appointment of Planning Commission member Bob David to a one year term as Vice-Chairman
Motion: Kendall/Manschot to re-appoint Bob David Vice-Chairman to the Planning Commission for a one year term. Motion Carries 7 ayes/0 opposed.
Possible amendment to Plan Commission By-law Guidelines for Certified Survey Map (CSM) Applications in reference to farmland separations. Chair Kendall reported the Board has had some confusion and the proper procedure is the Town is the last signature on any Certified Survey Map (CSM). The County, State, and any other appropriate entities see it first, and the Town motions to sign on approval of the other signing authorities. It comes first for review, and once final, all the official seals are affixed, and the Town would sign upon approval of the other authorities. He’d like to see that stated in our By-laws. Auberger questioned whether confident the Town is always the final signature. Kendall replied he ran it by our attorney.
Motion: Nowak/David, to add the proper language that in which the Town would sign at the end of the other approvals. Motion Carries 7 ayes/0 opposed.
Discussion: David suggested we review the By-laws for other changes before we make the amendment. Kendall tabled for next meeting to make amendment with no date. Motion: David/Auberger, to review the By-laws if we want to make any other amendments at this time. Motion Carries 7 ayes/0 opposed. Discussion: David suggested that we should review our fee schedule as well and have the Secretary research Comprehensive Plan Map Amendment Fee in particular.
Town’s Land Division Ordinance for Review
Chairman stated we last reviewed in November of 2010 and there has been some talk of possible land divisions happening, and doesn’t want to see us behind. Auberger suggested we review the Ordinance and have a meeting next month to discuss. Kendall stated Secretary wants to tie in our Model Developer’s Agreement to our application for plat of survey reviews (subdivisions). Secretary stated we would then have it signed by the applicant that the Agreement was presented to them, and would need to be part of the application and process.
Auberger asked if we have just one application for CSM’s and subdivisions? Secretary stated we do and one fee. He suggested we have two separate application forms as it is more involved with the larger plats. Secretary stated we should have a higher fee as well. Kendall tabled to next month. Auberger discussed his previous review and suggestions. He had suggestions for improvements but the review stated his opinion was the ordinance is solid, understandable, fair, and protective of the Town. David questioned cost. Kendall stated attorney cost estimate at that time for a complete revision was about $10,000.
Planning Commission Member to report to Town Board: May 9, 2012-Bob David or Craig Messerschmidt will report.
Walworth County Zoning Decisions - Including Board of Adjustment Decisions And Correspondence: Replacement of Zoning Code Enforcement Officer for Town of Troy-new Officer is Nicholas Sigmund. Keith Kasprzyk zoning permit denial L T 3600001A. Allen & Margaret Curler LTC 00025 Overhang, County extension date of June 13. John & Kristine Kendall LA198100002 Deck-has been removed and is in compliance. Proposed ordinance amendments: Shoreland Zoning Sec. 74-264.

Motion: Auberger/Nowak, to adjourn at 7:38 p.m. Motion carries 7/0.
